INTERNAL REGULATION

INTERPASS GOLF PLAYA COUNTRY CLUB

GENERAL PROVISIONS.
All persons accessing the Golf Playa Country Club Tourist Apartments are obliged to comply with the provisions of these regulations, as well as the Law “12/1999 of December 15, 1999 on Tourism”, which regulates Tourist Enterprises.

REGISTRATION OF ENTRY.
The accommodation in the apartments is conditioned to the presentation of the National Identity Card or Passport, as well as to fill out the documentation required at all times, for the authorities or company.

ENTRY AND PERMANENCE.
In compliance with the provisions of art.33 of the Tourism Law of Andalusia, access to tourist establishments is free without any prior restrictions. The owner of the company will be able to invite to leave the facilities, previous payment of the consumed thing, to all those people that do not fulfill the arranged thing in the art.
art.24 of the own law and expressed in this regulation of internal regime or that they try to accede and to remain in the same one, with a different purpose of the normal use of the services.
The condition of tourist user or client, is acquired when signing the mandatory document of admission in the Reception of the apartments.
To access to the interior dependencies of the apartments, as well as to consume in the different points of sale, it is essential to be registered as a client of the same one.

RATES AND BILLING.
The rates of prices are exposed in the Reception of the apartments, in addition to the places where the different services are rendered and they will be satisfied there or where they were presented to the client.
Independently of the fact that the company and the client may agree or not, at the moment of the admission or formalization of the reservation, the client may be asked for a credit card number, deposit or prepayment of a determined amount.
Payments for the different stay rates shall be computed per day, according to the number of overnight stays, with the minimum amount corresponding to one day, which shall be understood to end at eleven o’clock in the morning.

RECEPTION
Key reception: The key handover for the entrance to the apartment takes place from 5:00 p.m. onwards.
Departure: Departure from the apartment must be done before 11.00 am.
The company reserves the right to charge the client the amount corresponding to one night’s stay in case of not leaving the apartment at the stipulated time.
Early breakfast: If the guest is scheduled to depart before 08.00 am, a cold breakfast may be requested upon prior notification the day before to Reception.
Laundry: Laundry service is available to customers from Monday to Friday. Garments delivered before 09.00 a.m. will be returned within 24 hours.
The company is not responsible for the deterioration of these garments.

POOLS

POOL

Access to and use of the indoor pool facilities is restricted to children under 12 years of age, unless accompanied by a parent or guardian.

For the client’s safety, it is forbidden to dive “head first” in all pools.

Pool hours are from 10:00 am to 08:00 pm. After this time, the maintenance staff will proceed to carry out the necessary treatments so that the pool is in perfect condition.

Please refrain from swimming for your safety.

For sanitary reasons, the use of a shower is mandatory before immersion in the pool.

The use of bathing suits is mandatory, also for babies and children, and the use of diapers is forbidden.

Smoking is prohibited in the indoor pool area.

For safety reasons, the use of inflatable objects or balls is prohibited.

The use of music devices is not allowed in the pool area, as well as any electronic device that may interfere with the rest of the other guests.

For hygienic reasons, the consumption of food is prohibited in the entire pool area.

DECKCHAIR

The use and enjoyment of the sun loungers and umbrellas is free of charge. It is not allowed to reserve them with clothes or other objects if you do not use them. In case of need, the company’s staff may remove them.

OTHER PROVISIONS

  • For aesthetic reasons, it is not allowed to hang clothes or towels on the railing of the terrace.
  • The access to the different points of consumption of the hotel, implies its identification with the card of admission of client, for the purpose of control in its consumption and charge to its apartment.
  • It is forbidden to walk barefoot or shirtless in the interior facilities (corridors, Reception, Restaurant…).
  • It is not allowed to wear shorts and sleeveless shirts during dinner service.
  • The use of cell phones is forbidden inside the restaurant area.
  • Half board includes breakfast and dinner.
  • Guests who have booked a half board stay start their stay with dinner and end with breakfast on the day of departure.
  • It is not allowed to take food out of the consumption points.
  • Animals are not allowed in the common areas or inside the apartments.
  • The company reserves the right to charge to the client’s account, any damage or breakage that occurs in the content or container of the apartments, as well as in the rest of the facilities, produced by the client.
  • It is obligatory to keep silence in the corridors of the apartments after 22.00 hours, respecting the rest of the rest of the guests.

RULES FOR THE FORMALIZATION OF THE RENTAL CONTRACT

INTERPASS GOLF PLAYA COUNTRY CLUB

The company shall draw up the rental contract in duplicate, with both parties signing both copies and each party keeping one copy.

All the data referred to in the clauses of the contract shall be included.

The contracting parties may add as many stipulations as they deem pertinent, as long as they do not oppose the provisions of the “Ordinance of apartments, bungalows and similar tourist accommodations”.

The breach of these prescriptions on the formalization of the contract will not affect its validity, but will give rise to the administrative responsibility of the Company. However, all those clauses that oppose the rules of the aforementioned ordinance, whose application shall prevail between the parties, shall be null and void..

  1. Applicable standards: This contract shall be governed by the stipulations of the parties, by the provisions of the “Ordinance of apartments, bungalows and similar tourist accommodations”, approved by Ministerial Order of January 17, 1967, and in its absence, by the rules of common law that are applicable to it.
  2. Accommodations: The accommodations must meet, as a minimum, the conditions established in Article 9 of the aforementioned Ordinance, as well as those corresponding to their category, in accordance with Articles 13 and 17 of the aforementioned text.
  3. Services ancillary to lodging: The lodging includes the peaceful use and enjoyment of the apartment, bungalow or villa, of the services or facilities attached to it and of those common to the block or complex in which it is located (swimming pools, playgrounds, parking lots, etc.…) The price of the lodging will always include the supply of water, electricity, fuel, the delivery of the lodging and its clothes, in proper conditions of cleanliness and garbage collection (article 20).
  4. Complementary services: The company operating the accommodations may offer customers any complementary services it deems appropriate (laundry, cleaning of the accommodations, bar, restaurant or cafeteria, etc.), advertising their prices and issuing receipts for the payments made by customers for these items (article 21).
  5. Pricing: The prices to be charged for lodging shall be declared to the competent authority and displayed at the Reception of the establishment, according to the official sign.
  6. Global prices: All prices, both for lodging and for the complementary services offered by the company, shall be global, including the remuneration of the personnel and all taxes, duties and fees levied on this activity, as well as on the formalization of contracts (article 27).
  7. Payment of the price: The total amount of the accommodation must be paid by the customer, unless otherwise agreed, at the time of occupancy. If a deposit has been required for the reservation of the accommodation, the amount of the deposit shall be reduced when the price is paid (article 41).
  1. Reservation and cancellation of accommodations: By means of the appropriate agreement between the parties, the lodgings may be reserved in advance to the client, in concept of the price, consisting of a maximum of:Un 40% cuando la reserva sea por plazo inferior al mes.
  • 25% on reservations for one month.
  • 15% when the reservation is made for more than one month.

In the event of cancellation of reservations, the company must reimburse the client the amount received as a deposit, down payment or advance payment, and may retain it as compensation:

  • 5% of such deposit when the cancellation is made more than 30 days prior to the date set for occupancy of the accommodation.
  • 50% when the cancellation is made 30 days or less and more than 7 days.
  • 100% when the cancellation is made less than 7 days or the client does not show up on the agreed date (article 11.3 of the O.M. DE 15-09-78).
  1. Book-Register of Occupants: The prior registration of clients in the “Occupants’ Registry Book”, by showing their identity card or passport, shall be an essential requirement for occupying the lodgings (article 36).
  2. Occupancy of Accommodations: The right to occupy the accommodation shall begin, unless otherwise agreed, at 5:00 p.m. on the first day of the contracted period and shall end at 11:00 a.m. on the day following the day on which said period ends.
  3. Conditions of the accommodations on the day of occupancy: The accommodations shall be at the disposal of the clients, from the day set for their occupancy, in conditions of conservation, operation and cleanliness that allow their immediate use. In any case, the services referred to in the third general condition must be provided by the company from the moment the accommodation is occupied. It shall be understood that the clients are in agreement with the furniture and furnishings that appear in the inventory, as well as their perfect state of conservation and use if at the time of signing the inventory they do not raise any objection (article 35).
  4. Deposit: The companies may require, in order to respond for the loss or deterioration of the facilities, furniture and belongings, which are attributable to the clients, as well as the fulfillment of other obligations derived from the contract, the deposit at the moment of occupying the lodging, of an amount not exceeding 25% of the total amount of the agreed price. At the end of the contract, and once the accommodation has been vacated, said deposit shall be returned to the client, after any deductions that may be applicable (article 42).
  5. Repairs necessary for the preservation of the accommodations: Clients must facilitate the entry into the accommodations to the personnel duly authorized by the company to take care of the good state of conservation and operation of the accommodations, being obliged to tolerate the necessary repairs (article 43).
  6. Loss of accommodation conditions: When once the accommodation is occupied, for reasons not attributable to the client, it no longer meets the minimum conditions established in the Ordinance for those of its category, the client may choose to terminate the contract with the right to reimbursement of the amount corresponding to the period of time elapsed, unless a new accommodation of the same characteristics is provided (article 44).
  7. Eviction from the accommodations:  Once the agreed time has elapsed and, if applicable, the extensions established by mutual agreement between the company and the clients, the latter must vacate the accommodations. The company will be able to establish in the contracts as guarantee of the fulfillment by the clients of the previous obligation, the right to perceive in concept of compensation, a sum equivalent to the triple of the maximum price that corresponds to the days that exceed that in which the lodging should have been vacated. This will not be an obstacle for the exercise of the other rights and civil and penal actions that could correspond to the company, as well as for it to cease providing the services referred to in article 20 of the Ordinance that, due to the termination of the contract, it is not obliged to continue providing (article 45).
  1. Prohibitions to customers The customer is prohibited from:
  • To introduce furniture in the lodging or to carry out works or repairs in the lodging, no matter how small they may be, without written authorization from the company.
  • To lodge a greater number of persons than those corresponding to the maximum capacity set for the lodging.
  • To exercise the lodging activity in the lodging or to use it for purposes other than those for which it has been contracted.
  • To introduce explosive or flammable materials or substances or others that may cause damage or inconvenience to the other occupants of the property.
  • To carry out any activity that violates the usual rules of coexistence, morality, decency and public order.
  • To use, without written authorization from the company, devices that significantly alter the consumption foreseen in the supplies referred to in number 2 of article 20.

Failure by clients to comply with any of the prohibitions set forth in this article shall entitle the company to terminate the contract, with a refund of half the amount of the accommodation corresponding to the period of time not elapsed, retaining the other half as compensation (article 46).

  1. Liability for loss or deterioration of the effects brought in by customers: The company, as depositary, shall be responsible for the loss or deterioration of any effects brought in by guests, under the conditions established in articles 1783 and 1784 of the Civil Code (article 47).
  2. Complaint: The company shall always have, freely and free of charge, at the disposal of its customers, the required Complaint Forms, which shall also be posted at the Reception Desk.
